ANÁLISIS JURÍDICO MULTINIVEL, RIESGOS SOCIOAMBIENTALES Y PROSPECTIVA COMERCIAL BAJO EL ACUERDO INTERNACIONAL T-MEC: SUSPENSIÓN TEMPORAL DE LAS INSPECCIONES PARA LA EXPORTACIÓN DE AGUACATE MICHOACANO HACIA ESTADOS UNIDOS DE AMÉRICA
La suspensión temporal de las actividades de inspección de Estados Unidos en Michoacán para la exportación de aguacate durante agosto de 2026 constituye un caso paradigmático de la creciente interdependencia entre seguridad territorial, comercio agroalimentario, sanidad vegetal, gobernanza ambiental y cumplimiento de obligaciones internacionales. El objetivo de esta investigación es determinar la causa jurídica inmediata de la interrupción de la exportación por falta de seguridad de los inspectores en territorio, diferenciarla de los factores ambientales y estructurales que podrían afectar la continuidad futura de las exportaciones y construir una prospectiva comercial para el periodo 2026–2030. Se desarrolló una metodología jurídico-documental, multinivel, comparativa y prospectiva, mediante análisis de instrumentos internacionales, T-MEC, legislación mexicana y normativa de Michoacán, complementada con revisión de evidencia científica sobre cobertura forestal, agua, agroquímicos y servicios ecosistémicos. Los resultados muestran que la interrupción en el proceso de exportación de agosto de 2026 se explica primordialmente por condiciones de seguridad que afectaron la operación de personal estadounidense encargado de inspecciones, y no por una sanción comercial derivada de un incumplimiento ambiental demostrado del T-MEC. Sin embargo, se identifican brechas estructurales relacionadas con cambio ilegal de uso de suelo forestal, presión hídrica, degradación ecosistémica y gobernanza territorial que pueden incrementar el riesgo regulatorio y comercial. Abstract:
The temporary suspension of U.S. inspection activities in Michoacán for avocado exports during August 2026 constitutes a paradigmatic case of the growing interdependence among territorial security, agri-food trade, plant health, environmental governance, and compliance with international obligations. The objective of this research is to determine the immediate legal cause of the export disruption due to the lack of security for inspectors in the field, differentiate it from environmental and structural factors that could affect the future continuity of exports, and build a commercial outlook for the 2026–2030 period. A legal- documentary, multilevel, comparative, and prospective methodology was developed through the analysis of international instruments, the USMCA, Mexican legislation, and Michoacán regulations, complemented by a review of scientific evidence regarding forest cover, water, agrochemicals, and ecosystem services. The results show that the interruption in the export process in August 2026 is primarily explained by security conditions affecting the operations of U.S. personnel in charge of inspections, rather than a commercial sanction resulting from a proven environmental breach of the USMCA. However, structural gaps are identified concerning illegal forest land-use change, water stress, ecosystem degradation, and territorial governance, which could increase regulatory and commercial risks. The continuity of the U.S. market will depend on Mexico's capacity to demonstrate security, traceability, environmental legality, phytosanitary compliance, and territorial sustainability.
