GÉNERO Y DERECHO: ANÁLISIS DE LA JURISPRUDENCIA ECUATORIANA EN TORNO AL DERECHO DE LAS MUJERES A UNA VIDA LIBRE DE VIOLENCIA DURANTE EL PERÍODO 1998-2008
El trabajo estudia los avances y retrocesos en la interpretación judicial del derecho de las mujeres a una vida libre de violencia. Destaca que, a pesar del reconocimiento de los derechos de las mujeres en la Constitución Política del Ecuador de 1998, las sentencias de la Ex Corte Suprema de Justicia sobre violencia de género muestran un claro retroceso. Con la aprobación de la Constitución de 2008 la jurisprudencia de la Corte Nacional de Justicia experimenta una importante evolución, no obstante, las mujeres víctimas de violencia enfrentan la doble victimización y las omisiones de la política pública gubernamental.

Abstract:
The paper studies the advances and setbacks in the judicial interpretation of women's right to a life free of violence. It emphasizes that, despite the recognition of women's rights in the Political Constitution of Ecuador of 1998, the judgments of the Former Supreme Court of Justice on gender violence show a clear setback. With the approval of the 2008 Constitution, the jurisprudence of the National Court of Justice underwent an important evolution, however, women victims of violence faced double victimization and omissions of government public policy.
