FLORECIMIENTO, CREACIÓN Y TRANSFORMACIÓN DE LA EDUCACIÓN EN ESPAÑA: DE LA CONSTITUCIÓN DE 1812 A LA LEY DE INSTRUCCIÓN PÚBLICA DE 1857

Este artículo analiza los nuevos elementos que dotan a la instrucción de novedad y se encuentran en las diferentes ordenaciones legislativas en materia educativa entre el Informe Quintana de 1814 y la Ley de Instrucción Pública de 1857, conocida como Ley Moyano, en consonancia con la Constitución de 1812. Mediante un enfoque histórico-interpretativo, se examinan «unidades de análisis» extraídas de los textos legales, evaluando su coherencia en el arco cronológico propuesto y relacionándolas con los debates educativos en torno al mandato legal de 1857. Los resultados muestran que esta ley no solamente introduce innovaciones rupturistas respecto de las ordenaciones legales que la anteceden, sino también respecto de lo establecido en la enseñanza del Antiguo Régimen. Esta fractura se logró mediante la consolidación de algunas propuestas susceptibles de avanzar y modernizar en el contexto político y social de la primera mitad del siglo XIX. La aportación principal de este estudio radica en ofrecer una lectura transversal basada en tres ejes: la integración de disposiciones educativas más acordes con el progreso, la continuidad de esta idea y la incorporación de dichos elementos previos de manera acumulativa para formar una reglamentación educativa renovada, de conjunto, coherente y perdurable durante más de un siglo.

    This article analyses the new elements introduced into education through legislative regulations between Quintana’s Report of 1814 and the Public Education Law of 1857, known as the Moyano Law, in continuity with the Constitution of 1812. Adopting a historical-interpretative approach, it examines “units of analysis” drawn from legal texts, assessing their coherence over the proposed time frame and relating them to contemporary educational debates surrounding the 1857 legislative framework. The findings indicate that the law did not introduce radical innovations in relation to preceding legislative measures, but rather in contrast to the educational structures of the Old Regime. This transformation was achieved through the consolidation of proposals aimed at advancing and modernising the political and social context of the first half of the nineteenth century. The main contribution of this study lies in offering a cross-cutting interpretation structured around three axes: the integration of educational provisions aligned with notions of progress, the continuity of these principles over time, and their cumulative incorporation into a renewed, coherent, and enduring educational framework that remained in force for more than a century.
