ENTRE A SOBREPOSIÇÃO NORMATIVA E A IDENTIDADE: DESAFIOS DE GOVERNANÇA ENTRE A IP ALTA MOGIANA E A IP SUDOESTE DE MINAS

Este artigo analisa o fenômeno das Indicações Geográficas transfronteiriças, com foco na interseção territorial entre a Indicação de Procedência Alta Mogiana e a Indicação de Procedência Sudoeste de Minas Gerais, ambas vinculadas à produção cafeeira. O objetivo central é compreender como a sobreposição de áreas delimitadas impacta a governança, a identidade territorial e a possibilidade de uso legítimo dos signos distintivos por produtores situados em zonas de interseção. O estudo parte da dualidade entre território normatizado, instituído pelo poder jurídicoestatal e pelos atos administrativos do Instituto Nacional da Propriedade Industrial, e território identitário, compreendido como espaço usado, vivido e simbolicamente apropriado pelos sujeitos. A pesquisa é de caráter exploratório, bibliográfico e documental, sustentada pela análise da Lei nº 9.279/1996 (BRASIL, 1996), da Portaria INPI/PR nº 04/2022 (BRASIL, 2022), com alterações posteriores, do Manual de Indicações Geográficas (BRASIL, 2026), dos Cadernos de Especificações Técnicas das duas Indicações de Procedência e dos certificados de registro emitidos pelo Instituto Nacional da Propriedade Intelectual (INPI). Complementarmente, dialoga-se com a teoria das fronteiras étnicas e identitárias de Fredrik Barth (1969), com a noção de território usada de Milton Santos (2006) e com a contribuição de Amy Trubek acerca do gosto do lugar e do terroir como construção cultural, institucional e sensorial. Defende-se que a sobreposição entre IGs não constitui apenas uma inconsistência cartográfica ou administrativa, mas revela uma tensão mais profunda entre norma, pertencimento, reputação e governança. Conclui-se que a interseção territorial pode ser interpretada tanto como risco de fragmentação institucional quanto como oportunidade de cooperação entre signos territoriais, especialmente por meio de arranjos de governança compartilhada e estratégias de valorização territorial integradas.

    This article analyzes the phenomenon of overlapping Geographical Indications, focusing on the territorial intersection between the Alta Mogiana Indication of Source and the Sudoeste de Minas Indication of Source, both related to coffee production in Brazil. The main objective is to understand how overlapping delimited areas affect governance, territorial identity, and the legitimate use of distinctive signs by producers located in intersection zones. The study is based on the duality between the legally regulated territory, established by state power and by administrative acts of the Brazilian National Institute of Industrial Property, and the identity-based territory, understood as a used, lived, and symbolically appropriated space. The research is exploratory, bibliographic, and documentary, supported by the analysis of Law No. 9,279/1996, INPI Ordinance No. 04/2022, as amended, the Geographical Indications Manual, the Technical Specification Books of both Indications of Source, and the registration certificates issued by INPI. The article also dialogues with Fredrik Barth’s (1969) theory of ethnic and identity boundaries, Milton Santos’s concept of used territory, and Amy Trubek’s contribution on taste of place and terroir as a cultural, institutional, and sensory construction. It argues that the overlap between Geographical Indications is not merely a cartographic or administrative inconsistency, but reveals a deeper tension among law, belonging, reputation, and governance. The conclusion suggests that territorial intersection may be interpreted both as a risk of institutional fragmentation and as an opportunity for cooperation between territorial signs, especially through shared governance arrangements and integrated territorial valorization strategies.
